Criminal Practice Directive No. 9
The Court of Appeal has recently released Criminal Practice Directive No. 9 dealing with allegations of ineffective assistance of trial counsel. The directive was effective June 1, 2020.
As trial counsel you may be provided informal notice by appeal counsel that an allegation of ineffective assistance of trial counsel is being advanced. Alternatively, you may be notified of such an allegation by the Court of Appeal registrar.
If you become aware of such an allegation being advanced in relation to your trial work, you should notify SLIA immediately.
